President Obama Announces Immigration Plan

Denver, Colorado, November 20, 2014 – Here are a few highlights from the President’s planned executive action.

The President’s plan as described includes:

• Deferred Action for the parents of U.S. citizen and lawful permanent resident children who entered the U.S. on or before January 1, 2010 and meet all eligibility requirements.
• Expansion of Deferred Action for Childhood Arrivals (DACA) to individuals who entered the U.S. under age16 regardless of their age, entered the U.S. on or before January 1, 2010 and meet all other eligibility requirements.
• Allowing spouses and children of lawful permanent residents to apply for unlawful presence waivers from within the U.S. and ensuring appropriate standards for adjudicating those waivers.
• Granting parole in place for adjustment of status eligibility to more family members of individuals trying to enlist in the armed forces.
• Certain investors will be able to be paroled into the U.S., or be granted parole in place if already in the United States, for job creation.
• Entrepreneurs, researchers, inventors, and founders will be eligible for national interest waivers.
• Pre-registration for Adjustment of Status.  Individuals with an approved employment-based immigrant petition who are caught in the quota backlogs will be able to pre-register for adjustment of status to obtain the benefits of a pending adjustment. 
• Increasing access for university affiliated businesses to key talent and improving the rules for OPT
• Modernizing the PERM program and improving the AC-21 portability rules
• Releasing new L-1B guidance
• Directing agencies to look at modernizing the visa system, with a view to making optimal use of the numbers of visa available under law.
• Announcement of a new border security campaign and plan and replacing the controversial Secure Communities program with a “Priority Enforcement Program” program.
